2. Scope
These terms and conditions apply to the use of the website www.caralto.de, the Caralto app
and all related digital services.
Caralto is aimed at families, caring relatives, legal representatives, carers and other
authorised users who wish to organise information, documents, emergency data, tasks and care processes.
3. Description of services
Caralto provides a digital organisation platform. Depending on the scope of features, the following functions in particular may be offered:
- Care/support profile
- Emergency information
- Medication schedule
- Document safe
- Family access and role permissions
- Calendar, tasks and reminders
- Shares for authorised persons
- PDF exports
- later country modules, provider features and community features
The specific scope of features may vary depending on version, country, plan and technical availability.
4. No medical, nursing or legal advice
Caralto does not replace medical, nursing, therapeutic, legal or other professional advice.
All content, notes, checklists, reminders and export functions serve solely for organisation and documentation.
Medical decisions must not be made on the basis of Caralto alone.
In case of acute symptoms, emergencies or uncertainties, always contact qualified professionals or emergency services.
5. Registration and user account
A user account is required for certain features. Users must provide truthful information when registering
and keep their login details secure.
The user is responsible for ensuring that only authorised persons have access to their account or to shared areas.
6. Roles, shares and responsibility for content
Caralto may provide role and sharing functions. Users decide for themselves which information they record,
upload or share with other people.
The user is responsible for ensuring that they are entitled to enter, store and share personal data.
This applies in particular to data of people being cared for, health data, documents and emergency information.
7. Health and care data
Caralto may process particularly sensitive data such as health, care, medication and emergency data.
Using such functions requires that the data subject has given valid consent or that another legal
basis for processing exists, for example legal representation, power of attorney for care or other authority.
8. Emergency profile and public shares
Users can share certain information for an emergency profile or via QR/NFC functions.
The user is responsible for checking which data becomes visible before sharing. Caralto is not liable
if users themselves share inaccurate, outdated or excessive information.
9. Document safe and uploads
Users may only upload documents that they are entitled to store and use.
In particular, unlawful content, malware, forged documents or content that infringes third-party rights is not permitted.
10. Availability and technical changes
Caralto strives for reliable availability of the services. However, uninterrupted availability is not guaranteed.
Maintenance, security updates, technical faults or changes by third-party providers may temporarily restrict use.
11. Prices, subscriptions and payments
Paid features are offered as a monthly or annual subscription.
Payment is processed via Stripe. Prices, terms and cancellation conditions are shown before the contract is concluded.
For paid digital services, the user expressly confirms before purchase that Caralto begins providing the digital service before the withdrawal period expires. The user is aware that they may lose their right of withdrawal once the contract has been fully performed.
12. Cancellation
Users can cancel paid subscriptions in accordance with the conditions stated on the website or during the payment process.
Upon cancellation, access to paid features ends after the paid period expires, unless stated otherwise.
13. Right of withdrawal for consumers
Consumers resident in the EU generally have a statutory right of withdrawal. Details, conditions and the model withdrawal form are set out in our withdrawal policy .
14. Obligations of users
Users undertake in particular:
- not to provide false or misleading information,
- not to infringe third-party rights,
- not to enable unauthorised access,
- not to upload harmful software,
- to keep login details confidential,
- to check data regularly for accuracy.
15. Suspension and deletion
Caralto may suspend or delete accounts or content if there is reasonable suspicion of legal violations,
misuse, security risks or breaches of these terms.
16. Liability
Caralto is liable without limitation in cases of intent, gross negligence, injury to life, body or health, and under mandatory statutory provisions.
Liability is limited to foreseeable damage typical of the contract, to the extent permitted by law.
Caralto is not liable for medical, nursing or legal decisions made by users or third parties.
17. Third-party providers
Third-party providers may be used for technical services, in particular Supabase for technical infrastructure and Stripe for payments.
The respective terms and privacy information of third-party services also apply where the user uses those services.
18. Intellectual property
All rights to the brand, design, software, texts, features and other content of Caralto remain with Caralto or the respective rights holders.
Users only receive a revocable, non-transferable right of use within the scope of these terms.
19. Data protection
Information on the processing of personal data is contained in Caralto's privacy policy.
20. Changes to the terms
Caralto may amend these terms where there are objective reasons, in particular changes in the legal situation,
technical functions, business models or security requirements.
Users are informed of material changes in an appropriate manner.
21. Final provisions
Should individual provisions of these terms be invalid, the validity of the remaining provisions remains unaffected.
